The Government of India has agreed to extend the stay permit for Tibetan refugees in India to five years.

Kalon Tripa of the Central Tibetan Administration, Lobsang Sangay, announced earlier this week that the Government of India has accepted his proposal to extend the permit for a longer period. The term of the stay permit is currently six months to one year, depending on location.

In a letter obtained by Tibet Sun, the Ministry of Home Affairs told all the state governments and union territories, and all Foreigner Regional Registration Offices (FRROs), that the Ministry has accepted to extend the Registration Certificate (RC) for five years for Tibetans who are born in India and for those who have been living in India for more than 20 years.

The letter, dated 16 March, was sent by Deputy Secretary (Foreigners), Vinod Kumar. However, it is not clear when the state governments will start implementing the directive.

The Government of India issues Registration Certificate to Tibetan refugees which provides a six month to one year stay permit. Tibetans in Delhi must renew their RC every six months, while in Dharamshala they must renew every year. In Dharamshala, after filling up a form and registering their names in a log book, it takes a whole day to get the signature of the Assistant Superintendent of Police on the RC.

RC is also used as the official identity document of Tibetan refugees in India. Tibetans born in India must register for the stay permit when they turn 16 years of age. RCs are not issued to new arrival refugees.

India as a non-signatory nation to United Nations convention relating to the status of refugees 1951 and 1967 Protocol, Tibetans in India do not become naturalised, and therefore, Tibetans remain “foreigners” instead of “refugees”.
