Dear High Commissioner,

We write to you ahead of the last Human Rights Council during your tenure as High Commissioner for Human Rights, with a request to make the unjust sentencing of Tibetan shop-keeper and language rights advocate Tashi Wangchuk a major focus for you and your office. As you will be aware, Tashi was sentenced on 22 May 2018 to serve a five year prison sentence; having first been detained in January 2016, Tashi is now not due for release until January 2021. He has committed no recognisable crime, simply advocating - by legitimate, legal means - for Tibetan language rights supposedly enshrined in the Chinese constitution. China has convicted him for the highly politically motivated ‘offence’ of “inciting separatism”, an act that UN experts said "criminalize(s) the legitimate exercise of freedom of expression and his defense of cultural rights".

We urge you to make a strong statement of concern about the sentencing of Tashi Wangchuk, and call on China to release him immediately and unconditionally. We ask you to press China for guarantees that - whilst in custody - he will be treated with respect and not undergo any degrading or humiliating treatment, is protected from torture or other-ill-treatment, and is provided with independent medical care, and family visitation.

As you will be aware, scores of Tibetan human rights defenders are held in Chinese detention, and death and ill-health of Tibetan detainees is a serious issue. Human Rights Watch assessed that, between 2013 and 2105, 2.9 percent of known Tibetan political prisoners held by China died in custody (or shortly after release) as a result of mistreatment, which highlights a pattern of torture and mistreatment of Tibetans in detention. International Campaign for Tibet’s report ‘Torture and Impunity: 29 Cases of cases of Tibetan political prisoners’ concludes that although the People’s Republic of China officially prohibits torture, it has become endemic in Tibet, a result both of a political emphasis on ensuring ‘stability’ and a culture of impunity among officials, paramilitary troops and security personnel.

With China’s third cycle Universal Periodic Review now approaching, we request you to highlight China’s current failure to live up to many commitments made in its 2nd cycle Universal Periodic Review, including a visit by yourself, and other mandate holders, with unfettered access to Tibet, where Human Rights defenders such as Tashi Wangchuk are courageously speaking out.

We would like to thank you once again for your strong and principled stand on China’s rights violations in Tibet, and for your efforts to advance progress on this issue, during your term as UN High Commissioner for Human Rights. As we wrote previously, we are saddened that Tibet will lose one of its most powerful advocates, but we fully respect and understand your belief that re-appointment would be difficult without compromising your integrity.

You have set the bar high with your profound expressions of concern about Tibet, and we hope you will pass this principled position on to your successor, impressing upon them the importance of speaking out strongly on an issue that China is increasingly successful at suppressing.
